1. Agreement to Terms
By accessing or using Skilled.ph ("the Platform"), operated by Skilled.ph ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.
These terms apply to all users, including job seekers ("Workers"), employers ("Employers"), and visitors.
2. About the Platform
Skilled.ph is a direct hiring platform that connects US businesses with Filipino professionals. We provide tools for job posting, candidate discovery, applications, messaging, assessments, and referral programs. We do not act as an employer, staffing agency, or employment intermediary. All hiring relationships are directly between Workers and Employers.
3. Account Registration
To use the Platform, you must:
- Be at least 18 years of age
- Provide accurate and complete information during registration
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
You may register as either a Worker or an Employer. Each account is personal and may not be shared, transferred, or sold. We reserve the right to suspend or terminate accounts that violate these terms.
4. Worker Terms
Profile and Applications
Workers may create a profile including personal information, work history, skills, and assessments. You represent that all information you provide is truthful and accurate. You are responsible for keeping your profile up to date.
No Fees for Workers
Skilled.ph is free for Workers. We do not charge placement fees, take a percentage of earnings, or require payment to apply for jobs.
5. Employer Terms
Job Postings
Employers may post job listings that must accurately describe the role, compensation, and requirements. You may not post misleading, discriminatory, or fraudulent listings. We reserve the right to remove any job posting that violates these terms or our community standards.
Paid Services
Employers may purchase subscription plans, featured job placements, and job bounties. All payments are processed through Stripe. Subscription plans auto-renew unless canceled. We offer a 14-day refund policy for paid plans. One-time purchases (featured jobs, bounties) are non-refundable once activated.
Hiring Decisions
All hiring decisions are made solely by the Employer. Skilled.ph does not make employment recommendations, guarantees, or decisions on behalf of either party.
6. Bounty and Referral Programs
Referral Links
Workers receive a personal referral link to invite others to the Platform. Referral activity (clicks, signups, hires) is tracked and may contribute to contest scores and other rewards.
Job Bounties
Employers may attach a cash bounty to a job posting. Workers who share a bounty tracking link earn the bounty amount when their referred candidate is hired for that specific job, subject to the following conditions:
- The referred person must sign up through the tracking link
- The hire must occur within the attribution window (default 30 days)
- Last-click attribution applies — if multiple links are clicked, the most recent one before signup receives credit
- Self-referrals are prohibited
- Payouts are reviewed and processed by our team
- We reserve the right to reject payouts in cases of suspected fraud or abuse
Anti-Fraud
Creating fake accounts, manipulating click counts, or engaging in any scheme to fraudulently earn referral credit or bounty payouts will result in immediate account termination and forfeiture of all pending payouts.
7. Messaging and Communication
The Platform provides in-app messaging between Workers and Employers, and a support chat system. You agree not to use messaging for spam, harassment, solicitation of services outside the Platform, or any illegal purpose. We may review messages for safety and compliance purposes.
8. Content and Intellectual Property
You retain ownership of content you submit (profiles, resumes, job descriptions). By posting content on the Platform, you grant us a non-exclusive, worldwide license to display, distribute, and use that content in connection with operating the Platform. You may not post content that infringes third-party rights, contains malware, or violates applicable law.
9. Privacy
Your use of the Platform is subject to our Privacy Policy, which describes how we collect, use, and protect your information.
10. Prohibited Conduct
You agree not to:
- Provide false or misleading information
- Harass, abuse, or discriminate against other users
- Scrape, crawl, or use automated tools to access the Platform
- Circumvent security features or access controls
- Use the Platform for any illegal purpose
- Attempt to gain unauthorized access to other accounts or systems
- Interfere with the Platform's operation or infrastructure
11. Disclaimer of Warranties
The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the Platform will be uninterrupted, error-free, or secure. We do not warrant the accuracy of user-submitted content, the quality of candidates or job postings, or any outcome from using the Platform.
12. Limitation of Liability
To the maximum extent permitted by law, Skilled.ph shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to loss of profits, data, or business opportunities. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.
13. Indemnification
You agree to indemnify and hold harmless Skilled.ph from any claims, damages, or expenses arising from your use of the Platform, your violation of these terms, or your violation of any third-party rights.
14. Account Termination
You may delete your account at any time. We may suspend or terminate your account if you violate these terms. Upon termination, your right to use the Platform ceases immediately. Data may be retained as required by law or for legitimate business purposes.
15. Changes to Terms
We may update these terms from time to time. Material changes will be communicated via email or a notice on the Platform. Continued use after changes constitutes acceptance of the updated terms.
16. Governing Law
These terms are governed by the laws of the State of Utah, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Utah.
